The petitioner - appellant no.2 had filed a stay application in Civil Appeal No.14 of 2025, "Rajendra Singh Dafauti and Others vs. Madhan Singh", to stay the proceedings of Execution Case No.3 of 2025. Learned District Judge, Bageshwar has passed an order staying the execution of the money decree dated 06.06.2025, passed in Original Suit No.53 of 2023, "Madhan Singh vs. Rajendra Singh Dafauti and Others", upon deposit of 40% of the decretal amount. The present writ petition has been filed, being aggrieved by the said order dated 16.12.2025.
2. Heard Mr. C.S. Rawat, learned counsel for the petitioner.
3. Supplementary affidavit, filed by the petitioner, is taken on record.
4. As per the supplementary affidavit, the petitioner is a labour. He is not able to deposit the amount of 40% of the decretal amount. Petitioner is ready to furnish his share in ancestral property as a security.
5. Notice is being issued to the respondent before Admission.
6. Steps to be taken within three days by all the permissible modes including dasti, as prayed.
