BA1 No. 2162 of 2025
Hon'ble Alok Mahra, J.
Mr. Shivam Rana, learned counsel for the applicant.
2. Mr. V.S. Pal, learned A.G.A. for the State.
3. This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.22 of 2025, under Section 109(1), 121, 132, 191(2), 191(3) and 3(5) of B.N.S., 2023 and Section 4/25 of the Arms Act, registered at Police Station Joshimath, District Chamoli.
4. The First Information Report was registered against eight persons, including the applicant, under the aforementioned sections. Following investigation, a charge-sheet has been filed against all accused.
5. Learned counsel for the applicant submits that all co-accused have been granted bail by the learned trial Court and the applicant is in judicial custody since 30.06.2025, enjoy clean criminal antecedents, and belong to the Nihang Sikh community, having dedicated their lives to Sikh religious service. Learned counsel assures this Court that, if released on bail, the applicant shall not misuse the liberty granted, will fully cooperate in the trial, and will furnish bail bonds and sureties to the satisfaction of this Court.
6. Learned counsel for the State has vehemently opposed the prayer for bail. However, it is admitted that the co-accused have been granted bail by the learned Trial Court.
7. In light of the foregoing, the applicant's prolonged incarceration since 30.06.2025, his unblemished criminal record and also considering the fact that the co-accused have been granted bail by the learned Trial Court, this Court, without commenting on the merits of the case, is inclined to enlarge the applicant on bail at this stage.
8. The bail application is allowed.
9. Let the applicant, namely Amritpal Singh, be released on bail, on his executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
