The appellant proposes to challenge the judgment and order dated 23.12.2024 and 03.01.2025, passed in Sessions Trial No.82 of 2019, State Vs. Anuj @ Neelu, by the court of 3rd Additional Sessions Judge, Haridwar. In fact, by the common judgment, Sessions Trial No. 81 of 2019, State Vs. Anuj @ Neelu, was also decided by the same court, against which CRLA No. 24 of 2025, has already been admitted, and the appellant has been granted bail on 17.02.2026. This appeal is against conviction under Section 25 of the Arms Act, 1960 ("the Act"). The appeal is delayed. A Delay Condonation Application, IA No.1 of 2026, has been filed.
Learned counsel for the appellant submits that the appellant was convicted for offences punishable under Sections 302 and 506 IPC as well as under Section 25 of the Act. He has already preferred appeal for his conviction under Section 302 and 506 IPC, but he was not advised then to file appeal against his conviction under Section 25 of the Act. Therefore delay.
The delay condonation application is not objected to by learned State Counsel.
Having considered, we are of the view that there are good grounds for condonation of delay. Accordingly, the Delay Condonation Application deserves to be allowed.
The delay condonation application is allowed.
The delay in preferring the appeal is condoned.
Heard on admission.
