The appellants have challenged the award dated 07.06.2024, passed in in MAC No.07 of 2020, Smt. Sita Devi and Others Vs. The Oriental Insurance Company Limited and Another, by the court of Motor Accident Claims Tribunal/District Judge, Pauri Garhwal.
The appellants are claimants. They seek enhancement of the award amount.
It is delayed. The Delay Condonation Application, IA No.1 of 2025, has been filed.
Heard.
Learned counsel for the appellants submits that the appellants are aged parents; they came to know about the connected appeal when the notices were served upon them. Then they decided to file the appeal, and in that process, delay occurred.
The respondent nos.1 and 2 is not represented today. They have not filed any objection to the delay condonation application. The respondent no.3 is, in fact, a claimant, who happens to be the wife of the deceased Having considered, this Court is of the view that there are good grounds to condone the delay.
The delay in preferring the appeal is condoned.
The delay condonation application is allowed.
