The claimant seeks enhancement of award dated 10.07.2023, recorded by the Motor Accident Claims Tribunal/2nd Additional District Judge, Haldwani, District Nainital, in MACP Case No.72 of 2021, Bobby Sagar Vs. Manohar Singh Chufal and Others The appeal is delayed. The Delay Condonation Application, IA No.1 of 2025, has been filed.

Heard.

It is the case of the appellant that he is a poor person; he had no knowledge to prefer the appeal; after receiving the awarded amount, he came to know that that needs to prefer an appeal; he contacted his lawyer, and in that process, delayed occurred.

Learned counsel for the respondent no.2 submits that has not been sufficiently explained. Therefore, the delay condonation application deserves to be rejected.

Notices on the respondent nos. 1 and 3 have been served, but they are not represented.

Having considered, this Court is of the view that there are good grounds to condone the delay.

The delay in preferring the appeal is condoned.

The delay condonation application is allowed.
