2. Counter affidavit filed by respondent No. 3

is taken on record. Misc. Application (IA/2/2025) made therefor stands disposed of.

3. Petitioner is serving as Deputy General Manager in District Cooperative Bank. He was transferred from Uttarkashi to Chamoli vide order dated 30.07.2024. Feeling aggrieved by his transfer, petitioner filed this writ petition.

4. Coordinate Bench of this Court passed interim order on 07.08.2024 in favour of the petitioner, on the strength of which, he is still serving at the place where he was earlier posted.

Learned counsel for the petitioner submits that petitioner is due to retire in the month of July, 2027, therefore, he has less than 18 months to retire, therefore, petitioner's transfer at the fag end of his service is against the applicable policy. She has also drawn attention of this Court to Transfer Act, 2017.

6. Ms. Sangeeta Adhikari Patni, learned counsel holding brief of Mr. N.S. Pundir, learned counsel appearing on behalf of respondent/bank, however, submits that provisions of Transfer Act are not attracted to employees of District Cooperative Bank, as petitioner is not a government servant. She, however, assures that if petitioner makes representation against his transfer to the competent authority, the competent authority shall look into the matter and take appropriate decision, as per law.

7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the competent authority. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within six weeks thereafter.

8. For a period of eight weeks or till decision is taken, whichever is earlier, status quo, qua petitioner's posting shall be maintained.
