The respondent no.1 had filed a Claim Petition (Motor Accident Claim Petition No.95 of 2022, "Vikas Chandra Bairagi vs. Amanjyot Singh and Oriental Insurance Company Ltd."). The Motor Accident Claims Tribunal/ IInd Additional District Judge, Haldwani, District Nainital passed an ex-parte Award against the present petitioner on 07.11.2024. An Application (No.24 of 2025) has been filed by the present petitioner to set aside the said ex-parte Award.

The present petition has been filed under Article 227 of the Constitution of India to direct the Motor Accident Claims Tribunal/ IInd Additional District Judge, Haldwani, District Nainital to decide the said Miscellaneous Civil Case No.24 of 2025, "Amanjyot Singh vs. Vikas Chandra Bairagi and Another", as expeditiously as possible. 1

3. Heard Ms. Ananya Jain, learned counsel appearing for the petitioner.

4. This is an innocuous prayer.

5. The present petition is decided directing the learned Motor Accident Claims Tribunal/ IInd Additional District Judge, Haldwani, District Nainital to expedite the proceedings of the Miscellaneous Civil Case No.24 of 2025, "Amanjyot Singh vs. Vikas Chandra Bairagi and Another", and decide the same as expeditiously as possible and as per law without granting any unnecessary adjournment to either of the parties.

6. It is made clear that this Court has not expressed any opinion on the merits of the case.
