Mr. Subhash Joshi and Mr. Manish Kumar, learned counsel for the revisionist.
2. By means of present revision, the revisionist has assailed the judgment and order dated 10.10.2023, passed by Additional Chief Judicial Magistrate, Nainital in Criminal Case No.3743 of 2022, Manish Pargai vs. Rajan Lal as well as the judgment and order dated 27.01.2026, passed by 2nd Additional Sessions Judge, Nainital in Criminal Appeal No.5 of 2024, Rajan Lal vs. State of Uttarakhand & another.
3. The revision is accompanied along with an exemption application for exempting the revisionist from surrendering before the hearing of his bail application.
4. Since the matter pertains to Section 138 of the Negotiable Instruments Act, 1881, the exemption application (IA No.2/2026) stands allowed.
5. Counsel for the revisionist has made a statement that the revisionist is ready to pay the amount after adjusting the amounts already paid to the respondent.
6. Admit.
7. In view of the submission made by counsel for the revisionist, the bail application shall be considered after notice is served upon the respondent.
8. Issue notice to the respondent.
9. Counsel for the revisionist prays for and is 2 granted four days' time to take steps.
10. Summon the TCR.
11. List on 19.02.2026 for considering the bail application of the revisionist.
