Mr. Mani Kumar, learned counsel for the petitioner.
2. Mr. G.S. Sandhu, learned Addl. A. G. assisted by Mr. Deepak Bhardwaj, learned Brief Holder for the State/respondent nos.1 & 2.
3. By means of the present writ petition, the petitioner has sought quashing of FIR No. 10 of 2026 dated 11.01.2026, registered under Sections 115(2), 190, 191(2), 191(3) and 324(2) of the Bharatiya Nyaya Sanhita, at Police Station Dineshpur, District Udham Singh Nagar.
4. At the outset, learned counsel for the petitioner has referred to Annexure No. 5, being the order dated 23.01.2026 passed by a Coordinate Bench of this Court, and has submitted that the petitioner in the present writ petition is identically situated to the petitioner in the said case.
5. Learned counsel has further placed reliance upon the order dated 16.01.2026 passed by a Coordinate Bench of this Court in Anticipatory Bail Application No. 16 of 2026.
6. The aforesaid contention raised by learned counsel for the petitioner has not been disputed by learned counsel appearing for the State.
7. In such view of the matter, admit the petition.
8. Issue notice to respondent no.3. Steps to be taken within four days.
9. Having considered the submissions advanced by learned counsel for the parties, it is directed that no coercive action shall be taken against the petitioner in connection with the impugned FIR till the next date of listing.
10. Learned counsel for the State prays for and is granted four weeks' time to file counter affidavit.
11. List on 11.03.2026 with WPCRL No.159 of 2026.
12. Urgency application and stay application (IA Nos.1 & 2 of 2026) stand disposed of.
