2. Mr. Rakesh Negi, learned Brief Holder, for the State of Uttarakhand.
3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 480 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant, who has been accused in FIR No.127 of 2025, under Sections 351 (3), 64 (2) (f), 65 (1) of BNS and under Section 5(n)/6 of the POCSO Act, at Police Station Mukhani, District Nainital.
4. The report has been lodged by the mother of the victim who by profession is Medical Nurse, and the incident as narrated by the victim to the mother and detailed in the FIR is that while the mother (reporter) was on duty the Applicant (father of the victim) sexually exploited his own 13 years daughter i.e. victim.
5. Learned counsel for the Applicant submits, at the outset, that in the present matter the reporter (mother) and also the victim have not supported the prosecution story/case. Hence, at this juncture grounds for bail are sufficient.
6. Learned State Counsel, however, seeks time to file counter affidavit.
