In a suit filed by the respondent no.1 for perpetual injunction and possession, the appellant is defendant. The defendant sought the permission of the Court so that the respondent no.1 may not obstruct laying pipeline in the premises under the occupation of the appellant. That application was rejected by the impugned order dated 02.05.2025, passed in O.S. No.24 of 2020, by the court of 4th Additional Civil Judge (Senior Division), Dehradun.
One of the grounds for rejection is that if the appellant is in possession of the property since 2013, why application for getting water connection has been filed after 12 years. There is a status quo order between the parties. The Court also observed that perhaps the appellant intends to collect evidence.
Today, during the course of hearing, learned counsel for the respondent no.1 submits that, in fact, the appellant has unlawfully occupied the property. The electricity connection is in the name of the respondent.
The Court requested learned counsel for the appellant to tell as to whether any connection is in the name of the appellant in the property in dispute, particularly, electricity connection? He seeks time.
