2. Mr. J.P. Kandpal, learned Brief Holder for the State of Uttarakhand.
3. The present Bail Application has been moved by the Applicant - Nand Kishor alias Nandu, aged about 53 years, S/o Roopchand, R/o Maharajpur, Police Station Laksar, District Haridwar. The Applicant is in judicial custody in connection with FIR No. 1001 of 2024, registered at Police Station Laksar, District Haridwar, under Sections 8/22 of the N.D.P.S. Act, 1985.
4. Heard Mr. Rajveer Singh, learned counsel for the Applicant, and Mr. J.P. Kandpal, learned Brief Holder for the State. Perused the record.
5. Learned counsel for the Applicant submits that the Applicant has not committed the aforesaid offence as mentioned in the FIR and that all allegations against him are concocted; that there is no credible evidence to establish the commission of the alleged offence; that there is no independent public witness to the alleged recovery of ganja; that the grounds of arrest were not communicated to the Applicant and no copy of the grounds of arrest was supplied to him; and that the Applicant has been languishing in jail since 07.11.2024 and more than fifteen months have passed.
6. Learned State Counsel has opposed the Bail Application.
7. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant is entitled to be released on bail at this stage.
8. Accordingly, the Bail Application is allowed.
9. Let the Applicant be released on bail upon his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Court concerned.
10. All pending applications, if any, stand disposed of.
