2. Mr. Chittrarth Kandpal, learned Brief Holder for the State.
3. Present bail application is moved by the applicant-Hitanshu Gupta, who is in judicial custody in connection with Case Crime/FIR No.289 of 2025 under Sections 8/22/29 of Narcotic Drugs & Psychotropic Substances Act, Police Station Kotdwara, District Pauri Garhwal.
4. Heard learned counsel for the parties.
5. Learned counsel for the applicant submits that applicant has not informed about the offence for which he was arrested by the concerned police. He submits that on the basis of the confessional statement of Dr. Suraj applicant's name came into light. He submits that father of the applicant is having a valid license to run the medical shop and applicant is running that shop. He further submits that applicant has no criminal history and he undertakes to cooperate with the investigation.
6. Learned State counsel has vehemently opposed the bail application.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. Let the Applicant-Hitanshu Gupta be released on bail on furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the concerned court.
