3. Present bail application is moved by the applicant-Ajeet Singh @ Ajju, who is in judicial custody in connection with FIR No.05 of 2026 under Sections 8/20 of Narcotic Drugs & Psychotropic Substances Act, Chalani Police Station Salt, District Almora during the pendency of the trial before the court below.
4. Heard learned counsel for the parties.
5. Learned counsel for the applicant submits that no contraband has been recovered from the personal possession of the applicant and his implication is based solely on alleged presence of a passenger on a rear seat of the vehicle; there is no public witness of the incident. He further submits that applicant has been falsely implicated in the instant case as applicant is not the owner or driver of the alleged vehicle.
6. Learned State counsel has vehemently opposed the bail application.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. Let the Applicant-Ajeet Singh @ Ajju be released on bail on furnishing a personal bond and two reliable sureties each in the like amount to the satisfaction of the concerned court.
