2. Mr. J.P. Kandpal, learned Brief Holder for the State of Uttarakhand.

3. The present Bail Application has been moved by the Applicant - Aman, aged about 20 years, S/o Shri Pappu Singh, R/o Village Sakainiya, Post Office Subhash Nagar, District Udham Singh Nagar. The Applicant is in judicial custody in connection with Case Crime No. 12 of 2025, registered at Police Station Gadarpur, District Udham Singh Nagar, under Section 137(2) of the B.N.S., 2023 and under Sections 5/6 of the Protection of Children from Sexual Offences Act, 2012.

4. Heard Ms. Anmol Sandhu, learned counsel for the Applicant, and Mr. J.P. Kandpal, learned Brief Holder for the State. Perused the record.

Learned counsel for the Applicant submits that the FIR is a delayed one; that the star witness of the prosecution has not supported the prosecution version and has clearly stated that the injury was caused due to the child falling while playing with other children; that the medical evidence does not conclusively support the allegation of penetrative sexual assault and is consistent with an accidental injury, which creates serious doubt regarding the prosecution case; that the Applicant is an innocent young boy aged about 20 years and has no previous criminal history; and that the Applicant is languishing in jail since 13.01.2025, and due to prolonged detention his entire career is at stake.

6. Learned State Counsel has opposed the Bail Application.

7. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant is entitled to be released on bail at this stage.

8. Accordingly, the Bail Application is allowed.

9. Let the Applicant be released on bail upon his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Court concerned.

10. All pending applications, if any, stand disposed of.
