An Application under Order XXI Rule 29 and Section 151 of the Code of Civil Procedure, 1908 was filed by the revisionist - judgment-debtor. The said Application has been rejected on 03.04.2021 by learned Judge, Small Cause Court/ IInd Additional District Judge, Rishikesh, District Dehradun. Hence, the present civil revision.
2. Heard Mr. Siddhartha Singh, learned counsel for the revisionist and Mr. Piyush Garg, learned counsel for the respondents.
3. Supplementary affidavit dated 17.02.2026, filed by the revisionist, is taken on record.
4. Mr. Siddartha Singh, Advocate, has submitted that the revisionist undertakes to handover the peaceful possession of the shop (suit property) to the respondents - 1
2026:UHC:1276 decree-holders by 31.03.2026 and he will pay the occupation charges at the rate of Rs.4,200/- per month to them (respondents- decree-holders) and he (revisionist) further undertakes not to demolish the shop (suit property) and not to sublet the same.
5. Mr. Piyush Garg, Advocate, submitted on instructions, that the respondents do not want to opposed the said undertakings.
6. In view of the undertakings of the revisionist, the present civil revision (CLR No.38 of 2021) stands disposed of accordingly.
