2. This first bail application has been moved by the applicant seeking regular bail in F.I.R./Case Crime No.209 of 2025, under Section 109, 115(2), 117(2), 126(2), 191(3) and 351(3) of B.N.S., registered at Police Station I.T.I., District Udham Singh Nagar.
3. Learned counsel for the applicant submits that the persons named in the F.I.R. were identified solely on the basis of a viral video circulating online, which purportedly depicts the injured being assaulted and dumped near the railway track by the accused. He further submits that, upon careful perusal of the said viral video, the applicant does not appear in the footage. This fact stands corroborated by the statement of the injured himself. It is thus argued that the applicant has been falsely implicated in the instant case and has been languishing in judicial custody since 30.07.2025. Learned counsel assures that, in the event of bail being granted, the applicant shall not misuse the liberty so granted and will furnish bail bonds to the satisfaction of this Court.
4. Learned counsel for the State has vehemently opposed the prayer for bail.

Having regard to the fact that no specific role has been attributed to the applicant, no motive has been ascribed to him, he is not visible in the so-called viral video, and he has remained in custody since 30.07.2025, this Court, without expressing any opinion on the merits of the case, is of the considered view that the applicant deserves to be enlarged on bail at this stage.
6. The bail application is allowed.
7. Let the applicant, namely, Hariom be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
