2. Mr. S.S. Chauhan, learned DAG with Mr. Vikas Uniyal, learned Brief Holder, for the State of Uttarakhand.
3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant - Ravi, who has been accused in Case Crime No.0435 of 2025, under Sections 65 (1), 351 (2) of the BNS, 2023 and under Sections 3 and 4 of the POCSO Act, 2012 at Police Station Bajpur, District Udham Singh Nagar. The Applicant is in judicial custody since 20.12.2025.
4. Learned counsel for the Applicant submits that he has been falsely roped in the present matter.
5. Learned State Counsel submits that the present matter relates to girl child victim aged 13 years, and as per medico legal history the survival victim has narrated the incident to the Medical Officer stating that she was subjected to the sexual offence amounting to rape, and has specifically implicated the Applicant - accused.
6. Counter affidavit to be filed within a period of three weeks.
