Hon'ble Alok Kumar Verma,J.

The Trial Court had framed issue no.3 and issue no.4 regarding valuation and court fee. The said issues were decided in favour of the petitioners- plaintiffs. The respondents-defendants filed a Civil Appeal (Civil Appeal No.62 of 2016). The Civil Appeal has been allowed by learned IInd Additional District Judge, Haldwani, District Nainital on 30.05.2018. Hence, the present writ petition.

5. The petitioner no.1-Smt. Kiran Pandey is present in-person. She is identified by Mr. Anil Kumar Joshi, Advocate.

6. Mr. Khimanand Pandey-respondent no.1 is present in-person. He is identified by Mr. Yogesh Tiwari, Advocate.

7. The respondent no.2/2-Deepak Rautela and the respondent no.2/3-Divyansh Rautela are present in-person. They are identified by Mr. C.S. Rawat, Advocate.

8. Mr. Vinod Joshi, the respondent no.3, is present in-person. He is identified by Mr. Yogesh Tiwari, Advocate.

9. Both the parties submitted that they have settled their disputes amicably. They have filed a Settlement Deed dated 12.11.2025 (annexure no.1 to the Misc. Application IA No.16124 of 2025).

10. The parties submitted that they have settled their disputes with their free will and without any pressure. They are requesting to decide the present writ petition in terms and conditions of the Settlement Deed dated 12.11.2025 (annexure no.1). 2

11. On the request of the parties, the present Writ Petition (WPMS No.3060 of 2018) is disposed of in terms and conditions of the Settlement Deed dated 12.11.2025 (annexure no.1). The said Settlement Deed dated 12.11.2025 (annexure no.1) shall form part of this Order.
