Mr. D.S. Patni, learned senior counsel assisted by Mr. Dharmendra Barthwal, learned counsel for petitioner.
2. Mr. N.S. Pundir, learned D.A.G. with Mr. B.S. Koranga, learned Brief Holder for the State of Uttarakhand/respondent Nos.1 to 3 and 5.
3. Petitioner-Committee of Management is before this Court challenging the order dated 26.12.2025 passed by the Chief Education Officer, Udham Singh Nagar, whereby, letter dated 28.08.2025 moved by petitioner-Committee of Management to the Chief Education Officer for approval under Section 39 of the Uttarakhand School Education Act, 2006 for private respondent's suspension, has been rejected.
4. Learned senior counsel for petitioner submitted that respondent No.4 is the Principal of institution run by petitioner- Committee of Management. According to petitioner, since there were various serious charges against the respondent No.4, he was proceeded with departmentally by petitioner-Committee of Management and charge-sheet was also issued against him on 31.07.2025.
5. He further submitted that till date, respondent No.4 has not filed any reply to the charge-sheet dated 31.07.2025.
6. Issue notice to respondent No.4 returnable within four weeks.
7. Steps to be taken within 03 days.
8. Put up on 09.04.2026.
9. Meanwhile, respondents may file counter affidavit(s).
