This writ petition has been filed under Article 227 of the Constitution of India with the following prayers:-

"(i) Issue a writ, order or direction to the learned Civil Judge (S.D.), Roorkee to decide the O.S. No. 11 of 2005 Smt. Darshan Kaur and others Vs. Smt. Teji Bai and others, expeditiously and/or within the fixed time frame work as to be fixed by this Hon'ble High Court.
(ii) Issue any other suitable writ, order or direction which this Hon'ble Court may deem fit, just and proper in the circumstances of the case as also in the interest of justice.
(iii) Allow the writ petition with costs."

2. Heard Mr. Siddhartha Singh, learned counsel appearing for the petitioners - defendants (legal representatives of the deceased defendant no.1).

3. Mr. Siddhartha Singh, Advocate, submitted that on 29.10.2005, this Court passed the Order in Writ Petition Misc. Single No.1287 of 2005:-

"Thereafter, the trial of the suit shall proceed expeditiously so that the trial may be concluded within a period of six months."

4. Again, in a Civil Revision No.110 of 2016, this Court directed the trial court on 08.01.2020 to decide the suit expeditiously in accordance with law by giving ample opportunity of hearing to the parties.

5. Mr. Siddhartha Singh, Advocate, submitted that the said original suit is fixed for the cross- examination of the defendants (DW1 and DW2).

6. The original suit is pending since 2005. Under the circumstances of the said case, the learned Civil Judge (Senior Division), Roorkee, District Haridwar is directed to fast-track the proceedings and decide the case on merits, as per law, at the earliest but not later than three months from the date of production of the certified copy of this order.

7. It is made clear that this Court has not expressed any opinion on the merit of the case.

8. The writ petition (WPMS No.425 of 2026) stands disposed of accordingly.
