Mr. Prince Chauhan, learned counsel for the petitioner.

2. Mr. N.S. Pundir, learned Deputy Advocate General along with Mr. P.S. Bisht, learned Brief Holder for the State.

3. This writ petition has been filed by the petitioner seeking a direction to the respondent no.3-Regional Food Controller, Kumaon Region, Haldwani to forthwith return the FDRs amounting to Rs.15 lakhs to him.

4. It was contended by learned counsel for the petitioner that even after completion of the work assigned to him under the contract awarded by the respondent/State, two FDRs amounting to Rs. 15 lakhs have not been returned to the petitioner. On this submission, the learned Deputy Advocate General was directed to seek instructions in the matter vide order dated 20.02.2026.

5. Today, the learned Deputy Advocate General has received the instructions, which are taken on record. On the basis of instructions, he submits that a substantial amount is due from the petitioner;

therefore, the FDRs have not been released.

6. In such view of the matter, respondent/State is directed to file counter affidavit within four weeks.
