The petitioner claims that he was working with the respondent/University as Professor, who retired in the year 2019, but he has not been paid Leave Encashment, interest of delayed Gratuity payment, refund of amount deducted prior to payment of the commuted Pension, etc. The Court wanted to know from learned counsel for the University as to why there is so much delay? He seeks time to file counter affidavit.
These are very small issues. If really there are some genuine problems for grant of leave encashment, learned counsel for the University may get instructions and convey to the Court. If not, why those payments should not be immediately made?
Let learned counsel for the University get instructions. If the payment is due, let it be paid by the date fixed. If not, the reasons may be assigned so that the Court may proceed, accordingly.
