Ms. Alankriti Dwivedi, learned counsel holding brief of Mr. Varun Singh, learned counsel for applicant, appeared through Video conferencing.
2. Mrs. Pushpa Bhatt, learned A.A.G. with Mr. S.C. Dumka, learned A.G.A. for the State of Uttarakhand/respondent.
3. Mr. Prem Prakash Singh Phartiyal, learned counsel for complainant.
4. Today, matter is listed on Modification Application (MCRC/6/2025), whereby, applicant wants to modify Condition No.4 which has been imposed by this Court vide order dated 01.08.2025 while granting him permission to visit Australia. Condition 4 is as under:
"After arrival, he shall submit his passport before the learned Trial Court."
5. Learned counsel for applicant submits that pursuant to order dated 01.08.2025 passed by this Court, applicant had visited Australia, but he has not submitted his passport before the learned Trial Court.
6. Since, the applicant has not submitted his passport before the learned Trial Court even after returning from Australia, thus, Modification Application (MCRC/6/2025) is misconceived and the same is accordingly rejected.
7. However, it is made clear that the applicant shall submit his passport before learned Trial Court forthwith but not later than one week from today.
