Learned counsel for the applicant- petitioner had sought time to take appropriate steps to substitute the legal representatives of the deceased sole petitioner. Steps were not taken and none was present for the legal representatives of the deceased-petitioner on 02.04.2024. Therefore, the Writ Petition (WPMS No.809 of 2019) was dismissed for want of prosecution.
2. Heard Mr. Arvind Kumar Sharma, learned counsel for the proposed legal representatives of the deceased-petitioner, Mr. Ravi Bisht, learned counsel holding brief of Mr. Aditya Pratap Singh, learned counsel for the respondent nos.1 to 3 and Mr. V.D. Bisen, learned counsel for the respondent no. 10 on the aforementioned applications.
3. The said applications have not been opposed by the respondents.
4. Perused and gone through the record.
5. The Delay Condonation Application (IA No.3801 of 2025) filed in Restoration Application is allowed, but on the cost of Rs.10,000/-. The delay is condoned.
6. The Restoration Application (MCC No.3798 OF 2025) is allowed. Order dated 02.04.2024 is hereby recalled. The Writ Petition (WPMS No.809 of 2019) is restored to its original number.
7. Delay Condonation Application (IA No.3800 of 2025) in Substitution Application is allowed. Delay is condoned.
8. Substitution Application (IA No.3799 of 2025) is allowed.
9. Mr. Arvind Kumar Sharma, Advocate has sought two weeks' time to file an amended memo of cause-title.
10. On the joint request, list on 29.04.2026.
11. Registry is directed to show the name of Mr. V.D. Bisen, Advocate for respondent no.10 in the next cause list.
