On 24.05.2019, the petitioner was not present. Therefore, the writ petition (WPMS No.1078 of 2019) was dismissed for want of prosecution.
2. Heard Mr. D.S. Mehta, learned counsel for the applicant - petitioner on the delay condonation application and the restoration application.
3. Mr. D.S. Mehta, Advocate, submitted that the writ petition was fixed on 24.05.2019, but unfortunately, the said case was not marked by the counsel of the petitioner.
4. In the interest of justice, the delay condonation application is allowed. The delay is condoned.
5. The restoration application is allowed. The order dated 24.05.2019 is recalled.
6. The writ petition (WPMS No.1078 of 2019) is restored to its original number.
7. Notice is being issued to the respondent no.2. Steps to be taken within a week.
