It is argued that co-accused Devendra Kumar Sharma alias Sonu Bharadwaj, Ankush and Yogesh have already been granted bail. Their bail orders are from Page 83 to 88 on record, which reveals that they were granted bail on the ground that co- accused having similar role have already been granted bail.

Learned State counsel submits that, in fact, prior to them co-accused Harish Kumar Sharma and Sagar Yadav @ Shambu Yadav were granted bail the Court, but they were not named in the FIR.

Does it mean that while granting bail to Devendra Kumar Sharma alias Sonu Bharadwaj, Ankush and Yogesh, a wrong statement was given and accepted by the Court on the basis of acceptance by the State. If it is so, their bail needs to be cancelled.

List BA1 No. 2222 of 2024, Devendra Kumar Sharma @ Sonu Bharadwaj Vs. State of Uttarakhand, BA1 No. 553 of 2025, Ankush Vs. State of Uttarakhand and BA1 No. 776 of 2025, Yogesh Vs. State of Uttarakhand for hearing alonwith this bail application on 12.03.2026 as a first case after fresh.

Learned counsel who appeared for these three co-accused namely, Devendra Kumar Sharma @ Sonu Bharadwaj, Ankush and Yogesh is present today.

The Court would like her to reveal to the Court as to how the statement was given on behalf of these three co-accused that co- accused having similar role have already been granted bail? Who were those co-accused?
