Neelam Kandpal ............Petitioner
Vs.
State of Uttarakhand & others .............Respondents
Hon'ble Pankaj Purohit, J.
Mr. Kaushal Sah Jagati, Advocate for the petitioner.
2. Mr. N.S. Pundir, D.A.G. with Mr. Anil K. Dabral, Addl. C.S.C. with Mr. B.S. Koranga, B.H. for the State.
3. This writ petition has been filed under Article 226 of the Constitution of India, whereby the petitioner has sought a direction to the respondent-State to ensure the Holika Dahan celebration in a place which has been agreed upon by the local people, social workers, elected representatives of the area vide an agreement dated 22.11.2024, annexure no.2 to the writ petition.
4. I have heard learned counsel for the parties and perused the documents which have been relied upon by the learned counsel for the petitioner.
5. From bare perusal of the document, annexure no.2 to the writ petition, it is reflected that it is a document which has been prepared by the social workers and public representatives of the area and it has been agreed upon by them to celebrate Holika Dahan at a particular place.
6. Since State Government is not a party to the agreement entered into among the people, the petitioner instead of coming to the Court, may settle grievance by again meeting the people and elected representatives of the area.
7. This Court under Article 226 of the Constitution of 2 India declines to interfere in such matter.
8. Accordingly writ petition stands dismissed in limine.
