The case of the petitioner in WPSS No.2295 of 2025 was that he retired from his services in the year, 2012. He was getting pension Rs.12,600/- plus other allowances. By a communication dated 04.09.2025 of the Divisional Forest Officer, Bageshwar, the District Treasury Officer was directed to the pay the petitioner Rs.9,000/- plus allowances as pension.
2. This contempt petition has been filed alleging wilful disobedience of the order dated 30.12.2025 passed in WPSS No.2295 of 2025. By the said order, following direction was issued :-
"Having heard, as an interim measure, till the next date of listing, the operation of the impugned order dated 04.09.2025 shall remain in abeyance. No recovery shall be made from the petitioner".
3. Heard Mr. Mohit Bhauryal, learned counsel for the petitioner.
4. Mr. Mohit Bhauryal, Advocate submitted that in disregard of the order dated 30.12.2025, the petitioner was paid pension on 05.02.2026 at the reduced rate of Rs.9,000/- plus admissible allowances instead of the amount of Rs.12,600/- plus admissible allowances.
5. It is prima facie case of wilful disobedience of the order dated 30.12.2025.
6. Notice is being issued to the respondent. He is directed to appear through video conferencing before this Court on 12.03.2026 at 10.30 a.m. and clarify why proceedings should not be initiated against him for committing the contempt of Court.
7. Mr. Mohit Bhauryal, Advocate has sought three days' time to take steps.
8. Time is granted.
