5. In WPPIL No. 232 of 2025 titled as 'Shri Satnam Singh vs. State of Uttarakhand and others', a detailed order has been passed today after hearing counsel for the parties. The petitioner, therein, has been permitted to file objection before the Uttarakhand Pollution Control Board in respect of alleged breach of the conditions imposed by the Irrigation Department while granting the No Objection Certificate and on basis of which Consent to Establish was granted in favour of the private respondent. The Uttarakhand Pollution Control Board has been directed to examine the complaint and for a period of three weeks, the private respondent has been restrained from raising any further constructions. Thereafter, further construction has been made dependent on the outcome of the decision that would be taken by the Uttarakhand Pollution Control Board on the objection of the petitioner therein.
6. In the aforesaid facts and circumstances, we adjourn the hearing of the instant PIL for four weeks.
7. List in the week commencing 23.03.2026.
8. The Uttarakhand Pollution Control Board shall bring on record the decision as may be taken by it on the objection of the petitioner in the connected WPPIL No. 232 of 2025. In case any inspection is carried-out by the Uttarakhand Pollution Control Board for ascertaining and verifying the correctness of the objection that may be filed by the petitioner in the connected PIL, the same shall also be brought on record of the instant writ petition.
