1. Dr. K. H. Gupta and Rafat Munir Ali, learned counsel for the petitioner.
2. Mr. C. S. Rawat, learned Chief Standing Counsel, assisted by Mr. P.S.Bisht, learned Additional C.S.C. and Mr. Gajendra Tripathi, learned Standing Counsel for the State.
3. Submission is that the service rendered before the institution was taken on grant-in-aid list has been counted by the department itself in various cases on the basis of different orders passed in Writ Petitions filed before this Court. The appellant has already given undertaking by filing supplementary affidavit that he would not claim any financial benefit on the basis of the services aforesaid for the period prior to his retirement. In such circumstances, a liberal view should have been taken in respect of delay on the part of the appellant in approaching this Court.
4. Learned C.S.C. appearing on behalf the State prays for and is granted four weeks' time to file counter affidavit to the assertions made in the affidavit filed in support of the said application and also to the pleadings made in the writ petition.
5. List thereafter along with SPA No. 390 of 2025.
