1.Mr. Himanshu Yadav, learned counsel for the petitioners.
2. Mr. Narayan Dutt, learned Standing Counsel for the State of Uttarakhand.
3. Petitioners were engaged on contract as Junior Engineer in State Public Works Department. Their engagement was discontinued in the year 2021 and they are out of employment ever since then. They made a representation for their re- engagement, the representation was rejected on the ground that they participated in a strike; further that their name is not included in the list of 229 persons.
4. After arguing for a while, learned counsel for the petitioners submits that he is not pressing prayer no. 1 and the relief be confined only to prayer no. 2.
5. Having regard to the facts of the case, the writ petition is disposed of with liberty to petitioner to make a representation, for including their name in the list of 229 persons. If they make such representation to the Competent Authority within ten days from today, decision thereupon shall be taken, as per law, within five months thereafter.
