Mr. V.K. Kaparuwan, Mr. Krishan Mohan Joshi, learned counsel for the Applicant.
2. Mr. S.S. Chauhan, learned DAG with Mr. Vikash Uniyal, learned Brief Holder, for the State of Uttarakhand.
3. The present matter relates to an incident whereby the prosecution story narrated based on the FIR is that the victim/deceased i.e. father of the Applicant-accused, who is in judicial custody, cause the death of the victim, who happened to be the father along with his brother Shivam @ Harsh.
4. Today matter is listed for disposal of the bail application. Learned counsel for the Applicant submits that the co-accused has been granted bail. He further submits that the FIR was lodged by the landlord in the premises where the deceased live with the family and in his statement, he has stated that he did not witness the incident.
5. On the other hand, learned State Counsel refutes to the submission so submitted by the learned counsel for the first party. Firstly that it being a heinous offence and causing death of father by the own sons and secondly there are also eye witnesses to the said incident.
6. Three weeks' time is granted to the State to file counter affidavit.
7. List this matter on 11.03.2026.
