Mr. V. K. Kaparuwan, learned Central Government Standing Counsel for the Union of India/appellant.

2. Mr. Yash Bisht, learned counsel holding brief of Mr. Vikas Bahuguna, learned counsel for the respondent.

3. The respondent has filed a Misc. Application (IA No. 4101 of 2018) for taking counter affidavit/objection on record.

4. Misc. Application is allowed. The counter affidavit/objection filed on behalf of the respondent is taken on record.

5. Today, the matter is listed on Restoration Application (MCC No.571 of 2018) preferred by the appellant. The reason for dismissal of the present appeal is stated in paragraph no.3 of the affidavit in support of the restoration application. It is stated therein that the matter was listed on 23.03.2018 before the Hon'ble Court and the same was dismissed for want of prosecution due the reason, the counsel for the appellant could not appear in the matter.

6. On query from the learned counsel appearing on behalf of the respondent, he does not have any serious objection to the restoration application.

7. In such view of the matter, the Restoration Application is allowed. The present appeal is restored to its original number.

8. List this matter on 13.03.2026 for hearing on the Delay Condonation Application.
