This writ petition has been filed under Article 227 of the Constitution of India against the order dated 06.10.2025, passed by learned District Judge, Dehradun in RM74/426 of 2025, "Abhishek Sharma and Others vs. Veer Krishan Sharma and Others", whereby the learned District Judge has allowed the Application (No.6C2), filed by the respondent nos. 1 and 2 seeking leave to prefer appeal, filed along with an Application to condone the delay of 8319 days, against the judgment and decree dated 20.11.2002, passed in Original Suit No.629 of 2001, "Veer Krishan Sharma vs. Smt. Manoranjani Sharma and Others".

2. Heard Mr. Neeraj Garg, learned counsel for the petitioner and Mr. Piyush Garg, learned counsel for the respondent nos.1 and 2.
3. It has been requested by Mr. Piyush Garg, Advocate, on instructions, received from the respondent nos.1 and 2, that while setting aside the impugned order dated 06.10.2025, the learned District Judge, Dehradun may be directed to decide the said Application (No.6C2) afresh.
4. On the request of both the parties, the impugned order dated 06.10.2025, passed by learned District Judge, Dehradun in RM74/426 of 2025 is set aside. Learned District Judge, Dehradun is directed to decide the said Application (6C2) afresh after granting an opportunity of hearing to the parties.
5. The present Writ Petition No.619 of 2026 (M/S) is disposed of accordingly.
6. It is made clear that this Court has not expressed any opinion on the merit of the case.
