ORDER:(Per Hon'ble Justice Moushumi Bhattacharya)
1. We do not find any merit in the Writ Petition for Habeas Corpus since there is a decree dated 18.11.2025 already passed by the II Additional Family Court-cum-XV Additional Metropolitan Session Judge, at Kalpataru Complex, City Civil Court, Hyderabad ('Trial Court') in G.W.O.P. No.112 of 2025 filed by the petitioner herein. The decree records that the petition 2 filed by the petitioner is allowed in terms of settlement as reflected in Ex.C1/Mediation Report dated 23.10.2025, which also forms part of the record.
2. Hence, the petitioner has no cause of action with regard to the maintainability of the present writ petition for custody of minor child, who is presently with the respondent No.5/natural guardian of the alleged detenue. The petitioner has adequate statutory recourse available to him in the event the petitioner is aggrieved by the decree passed by the Trial Court.
3. Moreover, the learned Government Pleader appearing for the respondent Nos.1 to 4 submits that the respondent No.5 resides in Bidar in the State of Karnataka.
4. W.P.No.5971 of 2026, along with all other connected applications, is accordingly dismissed. There shall be no order as to costs.
