ORDER:

This Writ Petition is filed seeking to declare the action of the respondent authorities in not reissuing the passport to the petitioner (minor), who was holding Passport No.U7335105, and in keeping the same on hold on the ground that his mother's name is not mentioned in his father's passport, as arbitrary, illegal, and violative of Articles 14 and 21 of the Constitution of India; and consequently to direct the respondent authorities to forthwith reissue the passport to the petitioner (minor) to enable him to travel abroad to the U.K. for medical treatment.

2. Sri Mir Ahmed Khan, learned counsel for the petitioner and Sri K. Karuna Sagar, learned Standing Counsel for Central Government, for respondent Nos.1 and 2.

When the matter is taken up for hearing, learned counsel for the petitioner submits that, in similar circumstances, this Court, while dealing with Writ Petition No.5451 of 2025, by order dated 31.10.2025, allowed the said writ petition by directing the official respondents to issue passports to the petitioners' minor grandchildren in accordance with law, and prays for a similar order in the present case.

4. Despite due service of notice on respondent No. 3 and filing of proof of service, none has entered appearance on his behalf.

5. Learned Standing Counsel appearing for respondents Nos.1 and 2 submits that if appropriate orders are passed by this Court, respondent No.2 will consider the case of the petitioner and re-issue passport in accordance with law.

6. Accordingly, in terms of the order passed by this Court in W.P.No.5451 of 2025, dated 31.10.2025, and for the reasons alike, this Writ Petition is allowed by directing the official respondents to consider the case of the petitioner and re-issue passport to the petitioner (minor), in accordance with law. No costs.

Miscellaneous petitions, if any pending, shall stand closed.
