ORDER:

In view of elevation of the learned counsel for the petitioner on record as the Hon'ble Judge at High Court of Andhra Pradesh, this Court has directed the Registry to issue notice to the petitioner on 04.02.2026 and the notice sent to the petitioner was unserved with endorsement 'door locked'.

2. In the instant writ petition, the petitioner is questioning the action of the respondent No.1 in passing the impugned order in rejecting his case for promotion to the post of Junior Assistant vide proceedings Memo 2 SK, J W.P.(TR).No.347of 2017 No.18227/R&R-A2/2012-2 dated 18.12.2012 on the ground that the petitioner was accepted the appointment as Office Subordinate and joined to duty as Office Subordinate and he will be governed by A.P.Last Grade Service Rules in vogue, according to which he must have to complete 5 years of continuous service in the cadre of Office Subordinate and he will be considered for the post of Junior Assistant as per his seniority, rule of reservation and availability of vacancies for appointment by transfer from Office Subordinate to the post of Junior Assistant, which service is being governed by the A.P. State and Subordinate Service Rules.

3. The respondent No.1 filed counter reiterating the contentions as stated in the impugned Memo dated 18.12.2012. Moreover, the petitioner has accepted the appointment as Office Subordinate and joined duty on 30.07.2009 and immediately after joining duty after three months, he made a representation to the authorities to consider his case of promotion to the post of Junior Assistant and the respondents have passed the impugned 3 SK, J W.P.(TR).No.347of 2017 order rejecting his case for promotion. Once the petitioner has joined duty accepting the appointment as Office Subordinate on 30.07.20209, he has no right to seek promotion immediately to the post of Junior Assistant. In view of the same, there are no grounds in the writ petition warranting interference by this Court.

4. Accordingly, the Writ Petition is dismissed. No order as to costs. .

5. Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
