ORDER:

Heard Sri S.Nyaya Murthy, learned Counsel appearing for the petitioner and learned Assistant Government Pleader for Services-I appearing for the respondents. Perused the material on record.

Learned Counsel for the petitioner submits that the petitioner is seeking promotion to the post of Executive Engineer along with other as per his seniority 2 SK,J W.P(TR).No.153 of 2017 with all consequential benefits and the respondents are not considering the case of the petitioner in view of pending ACB case against the petitioner. At the time of admission, the Andhra Pradesh Administrative Tribunal (APAT) has granted interim order directing the respondents to consider the claim of the petitioner for promotion to the post of Executive Engineer in any one of the existing vacancies duly placing his name in the review D.P.C. without reference to the charges. Immediately, the respondents have filed vacate petitioner without complying the order of the APAT. Pending instant writ petition, the ACB case against the petitioner in C.C.No.7 of 2013 on the file of competent Criminal Court was disposed of convicting the petitioner on 29.08.2018. Aggrieved by the said order, the petitioner filed Crl.Appeal.No.2575 of 2018 before this Court and the same was allowed on 17.02.2021 by setting aside the order passed by the Trial Court dated 29.08.2018 and respondent authorities also registered another case in C.C.No.42 of 2016 against the petitioner and was same 3 SK,J W.P(TR).No.153 of 2017 withdrawn by the Government. The petitioner retired from service on 30.04.2017. In view of the same, the petitioner seeks liberty to make representation to the competent authorities for considering his promotion on par with his junior along with all the consequential benefits, in view of disposal of criminal case against the petitioner and requested to direct the respondent authorities to consider the same and pass appropriate orders as per law.

3. Learned Assistant Government Pleader for Services-I submits that if the petitioner makes representation before the respondent authorities, the respondents will consider the same and pass appropriate orders in accordance with law in due course and requested to pass appropriate orders.

4. In view of the submission made by learned Counsel on both sides, the Writ Petition (TR) is disposed of by granting liberty to the petitioner to make representation to the competent authorities for considering his case for 4 SK,J W.P(TR).No.153 of 2017 promotion on par with his juniors in pursuance of disposal of criminal case against the petitioner. After submitting the said representation, the respondents are directed to dispose of the same by passing appropriate orders as per law within three (3) months from thereafter and communicate the same to the petitioner. There shall be no order as to costs.

As sequel to it, Miscellaneous Petitions, if any pending in this Writ Petition (TR) shall stand closed.
