                                        ORDER

This Contempt Case is filed alleging non-compliance of the order dated 13.06.2025 passed by this Court in Writ Petition No.15991 of 2025.

2. This Court vide order dated 13.06.2025 disposed of W.P.No.15991 of 2025, which reads as follows:

"6. In view of the above submissions, this Court deems it appropriate to dispose of the writ petition permitting the petitioner to make F-Line application, duly enclosing the documents and land particulars, which are necessary for conducting survey and in the event of such an application being submitted by the petitioner and if the petitioner fulfils all the requirements mentioned in the circulars issued by the Commissioner, Survey, Settlements and Land Records from time to time, respondent No.5 shall conduct the survey, after issuing notices to all the persons interested and adjacent pattadars and after considering their objections, within a period of eight (8) weeks from the date of receipt of the application."

The learned Assistant Government Pleader for Revenue has filed counter affidavit of the respondent and submitted that the respondent has complied with the order dated 13.06.2025 passed by this Court in W.P.No.15991 of 2025 and issued Endorsement dated 11.12.2025 vide No.F/MS/3805/2025. It is further submitted that the said endorsement was duly served on the petitioner.

4. A copy of the Endorsement dated 11.12.2025 has been placed before this Court. The relevant portion of the said endorsement reads as follows:

"Through the reference 4th cited, the Mandal Surveyor, Mahabubnagar, has reported that the tippons of the 27.11.2025 at 10:30 AM subject lands are not available. However, as per the directions of the Hon'ble High Court, the Mandal Surveyor issued notices fixing the date of demarcation as to all interested persons and adjacent pattadars. He proceeded to the subject land along with the petitioner and attempted to trace the boundaries of Sy. Nos. 566 and 567 with the help of the Village Map. However, the boundaries could not be fixed as several private layouts have come up in and around the said survey numbers.
Therefore, the Mandal Surveyor could not fix the boundaries of the land Sy.Nos. 566 and 567 of Mahabubnagar Town."

This Court, in W.P.No.15991 of 2025 directed the respondent to consider the petitioner's application for conducting an F-Line survey and to conduct the survey if the petitioner fulfilled the requisite requirements. Since the respondent has acted upon the application and issued an Endorsement dated 11.12.2025 explaining the technical 3 inability to fix boundaries due to the non-availability of tippons and the emergence of private layouts, it cannot be said that there is any willful or deliberate disobedience of the orders passed by this Court. If the petitioner is aggrieved by the said Endorsement, it is open to him to challenge the same by filing an appeal before the competent authority or by availing remedies available under law. However, the present Contempt Case is not the appropriate remedy to adjudicate upon the merits of the Endorsement issued by the respondent. In view of the above facts and circumstances, this Court finds no merit in the Contempt Case.

6. Accordingly, this Contempt Case is closed.

Miscellaneous petitions, if any, shall stand closed.
