ORDER:

Heard learned counsel for the petitioners, learned Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1, Sri.Raparthi Venkatesh, learned standing counsel for GHMC appearing for respondent Nos.2 to 5.

2. This writ petition has being filed seeking the following prayer:-

"a) to declare the action of the Respondent No. 4 and 5 in issuing the impugned Speaking Order dated 09.01.2026, directing the Petitioner to remove the alleged deviation to construction within 15 days, as being bad, arbitrary, high-handed, illegal, unconstitutional and violative of Articles 14, 21 and 300A of the Constitution of India and also contrary to the principles of natural justice and consequently direct the Respondents not to take any coercive steps in respect of construction in Bearing Plot No.74, in Portion L and O in Survey No.41/Part and Plot No.75 Block No."O" admeasuring 600 Sq.yards, situated at Parama Reddy Hills, Upperpally Village, Attapur Circle, Ranga Reddy Circle.
b) Consequently set aside the impugned Speaking Order dated 09.01.2026 issued by the Respondent No.4."

Learned standing counsel appearing for respondent Nos.2 to 5 placed on record instructions issued by the respondent No.5, wherein it is submitted that on 17.11.2025, one Habeedbuddin Qureshi made a complaint alleging 2 that the petitioners are making unauthorized construction on the subject property. On such complaint, the subject property was inspected and the respondent authorities issued notice dated 21.11.2025 under Section 635 of the GHMC Act, 1955. Thereafter, show cause notice dated 24.11.2025 was issued and subsequently speaking order dated 09.01.2026 was also issued. Learned standing counsel further submits that the subject property is sealed and submits that the respondent authorities would take appropriate action including removal/demolishing of the subject property.

4. At this stage, Sri.Ram Singhal, learned counsel appearing on behalf of counsel for the petitioners through virtual mode sought permission of this Court to withdrawn this writ petition with a liberty to seek appropriate remedy as available under law.

5. Recording the above submission, permission is accorded to the petitioners to withdraw the writ petition with a liberty to avail appropriate remedy as available under law.

6. Accordingly, this writ petition is dismissed as withdrawn. As a sequel, I.A.No.3 of 2026 (Implead petition) and other miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
