ORDER :

(ORAL) This writ petition is filed seeking to declare the action of respondent No.2 in not taking any action pursuant to the proceedings No.B/1864/2018 dated 09.10.2018 for grant of Occupancy Rights Certificate (ORC) in favour of the petitioner in respect of the land admeasuring Ac.1-00 guntas in Survey No.1-00 guntas in Survey No.780/C2, situated at Gadwal Village and Mandal, Jogulamba Gadwal District, as being illegal, arbitrary and unconstitutional.

2. Heard Mr. M.Vidyasagar, learned counsel for the petitioner; Mr. L.Ravinder, learned Assistant Government Pleader for Revenue, appearing for the respondents; and perused the material on record. 2

The case of the petitioner is that she had been in possession of the subject land which was classified as inam land from the time of their ancestors and the name of her husband was recorded as possessor in respect of the subject land. That on application submitted by the petitioner for issuance of ORC under the Telangana Abolition of Inams Act, 1955, proceedings were initiated vide No.B/1864/2018 dated 09.10.2018. Learned counsel for the petitioner submitted that pursuant to the said proceedings, no action has been taken so far. It is submitted that the petitioner earlier filed W.P. No.41415 of 2022 seeking the same relief and the order dated 14.11.2022 was passed by this Court disposing of the same with a direction to the respondents therein to dispose of her application within a period of eight (8) weeks from the date of receipt of a copy of the order. However, no action has been taken so far. The petitioner could not get the order implemented and contempt case was not filed as the limitation time stood expired. As there is delay on the part of respondent No.2 in acting upon the proceedings dated 09.10.2018, the petitioner is constrained to approach this Court.

4. Learned Assistant Government Pleader for Revenue submitted that appropriate action will be taken pursuant to the proceedings dated 09.10.2018 in accordance with law.

Recording the aforesaid submission, without entering into the merits of the case, this writ petition is disposed of directing respondent No.2 to forthwith take action pursuant to the proceedings No.B/1864/2018 dated 09.10.2018 for grant of Occupancy Rights Certificate (ORC) in favour of the petitioner in respect of the land admeasuring Ac.1-00 guntas in Survey No.1-00 guntas in Survey No.780/C2, situated at Gadwal Village and Mandal, Jogulamba Gadwal District, by giving opportunity of hearing to the petitioner and to all other concerned/interested persons, and pass appropriate orders in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition, stand closed.
