ORDER:
This Writ Petition is filed seeking to declare the action of respondent No.3 in not renewing the petitioner's passport bearing No. Z8313558, pursuant to Application No. US8075584492725, on the ground of a pending criminal case in Crime No.122/2023 on the file of P.S. Gachibowli, for the offences under Sections 448, 506, and 290 IPC, in which a charge sheet has been filed and taken cognizance as C.C.No.0122/2023 on the file of the learned X Additional Metropolitan Magistrate, Cyberabad at Kukatpally, as illegal, arbitrary, unconstitutional, and violative of fundamental rights, and contrary to the provisions of the Passports Act, 1967, and consequently direct respondent No.3 to renew the petitioner's 2 passport bearing No.Z8313558 pursuant to Application No.US8075584492725, without reference to the said criminal case.
2. Heard Ms. Mukkera Sahithi Sri Kavya, learned counsel for the petitioner; Smt. NVR Rajyalakshmi, learned Standing Counsel for Central Government representing Sri N. Bhujanga Rao, learned Deputy Solicitor General of India, for respondent Nos.1 and 3 and learned Government Pleader for Home, for respondent Nos.2, 4 to 6.
3. Learned counsel for the petitioner made submissions on the lines of writ affidavit and requested this Court to direct the respondent authorities to consider the aforesaid petitioner's application as expeditiously as possible.
4. Learned counsel for the respondents submits that if the aforesaid petitioner's application is still pending, the respondent authorities may be directed to consider the same and pass appropriate orders in accordance with law.
5. In view of the submissions made by the learned counsel appearing on either side, and without expressing any opinion on the merits of the case, this Writ Petition is disposed of by directing the respondent authorities to consider the aforesaid petitioner's 3 application, if pending, and to pass appropriate orders in accordance with law, within a period of three (03) weeks from the date of receipt of a copy of this order, and to communicate the same to the petitioner. No costs.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
