CRIMINAL PETITION No.3530 of 2024
ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioner/Accused to modify the order, dated 15.12.2023 passed in Crl.M.P.No.422 of 2023 in Crl.A.No.131 of 2023 on the file of learned II Additional District and Sessions Judge at Medchal. By the impugned order, the petition filed by the petitioner under Section 389(1) of Cr.P.C, was allowed directing the petitioners to deposit 10% of the compensation amount.
2. Heard Sri P.Venkanna, learned counsel for the petitioner and Sri S. Ganesh, learned Assistant Public Prosecutor for respondent No.1 - State.
3. Learned counsel for the petitioner submitted that the petitioner is not financially stable to deposit 10% of the compensation amount. In this regard, he placed reliance on the judgment of the Apex Court in Jambu Bandari vs. Madhya Pradesh State Industrial Development Corporation Limited 1 and prayed to allow the petition.

4. Considering the submissions made by the learned counsel for the petitioner and circumstances of the case, this Court is inclined to reduce the compensation amount from 10% to 5% to be deposited by the petitioner.
5. Accordingly, the Criminal Petition is disposed of directing the petitioner to pay 5% of the compensation amount i.e., Rs.10,02,000/-(Rs.2,00,40,000/- x 5%) within a period of one (01) month from the date of receipt of copy of this order.
Miscellaneous applications, if any pending, shall also stand closed.
