CRIMINAL REVISION CASE No.520 OF 2010
JUDGMENT:
This Criminal Revision Case is filed by the petitioner aggrieved by the judgment dated 29.12.2009 in C.C.No.1611 of 2005, on the file of Principal Judicial Magistrate of First Class, Mancherial, acquitting the accused for the offence under Section 138 of the Negotiable Instruments Act, 1881.
2. None appeared for the revision petitioner/accused on 03.06.2024, 11.06.2024 and 19.06.2024. Even today, there is no representation, though the matter is posted under the caption 'for dismissal'.
3. In cases of acquittal, Appeal has to be filed and not the Revision Case. The High Court is barred from reversing an order of acquittal under Section 401(3) of Cr.P.C. to one of conviction.
4. Accordingly, the Criminal Revision Case is dismissed. Miscellaneous applications pending, if any, shall stand closed.
