And whereas the High Court upon, perusing the petition and the Memo. of grounds filed herein, and upon hearing the arguments of the Govt. Pleader for Arbitration(TG) on behalf of petitioner, directed issue of notice to the Respondents herein to show cause as to why this Civil Revision Petition should not be admitted;

THE COURT FURTHER MADE THE FOLLOWING ORDER :-
"The Revision Petitioner is the State, filed this Revision challenging the Order in E.P.No. 37 of 2004 passed by the I Additional District Judge, Nizamabad, whereunder the claimant was permitted to recover interest. But in Appeal No. 445 of 1998 the Division Bench of this Court clearly held that the claimants are not entitled to interest from the date of taking possession till the date of deposit. Thus, prima facie the claimants are not entitled to claim interest for the said period.
During pendency of this petition, there shall be ad interim stay of recovery of interest from the date of taking possession till the date of the deposit in view of the Division Bench Judgment of this Court in A.S.No. 445 of 1998.
Issue notice to the respondents."
