CRIMINAL APPEAL NO.97 OF 2024
ORDER:
1. This Criminal Appeal is filed against the judgment and acquittal in S.C.No.279 of 2022 on the file of the II Additional Assistant Sessions Judge, Medchal-Malkajgiri District at Kushaiguda acquitting the respondent/accused for the offences under Sections 307 and 506 of IPC.
2. The appellant is the complainant. Any conviction recorded by the learned Assistant Sessions Judge, on the basis of judgment would lie to Sessions Judge or High Court. The present case is the case of acquittal, as such, the appeal against the judgment learned Assistant Sessions Judge would lie to the District Judge under proviso to Section 372 of Cr.P.C.
3. Therefore, Registry is directed to return the bundle to the appellant to enable him to file the appeal before the District Court.

4. With the said observation, the Criminal Appeal is disposed off. Miscellaneous applications, pending if any, shall stand closed.
