ORDER:

Heard S. Nagesh Reddy, learned counsel appearing on behalf of the petitioner, learned Assistant Government Pleader for Energy appearing on behalf of respondent No.1 and Sri R.Vinod Reddy, learned Standing Counsel for TSSPDCL appearing on behalf of respondent Nos.2 and 3.

2. The petitioner approached the Court seeking the prayer as follows:

"....to grant an order direction or writ more so in the nature of Writ of Mandamus declaring the action of the official Respondent Nos.2 and 3 in disconnecting the power supply and removing the electrical lines of the Petitioner whose connection is Meter No.7451269 without issuing any notice as illegal, arbitrary and highhanded apart from being violative of Articles 14 and 21 of the Constitution of India and the Judgment rendered by the Division Bench of this Hon'ble High Court in W.A.No.269 of 2018 dt 02.02.2018 and consequently direct the Respondent Nos.2 and 3 herein to restore the power supply and electrical lines including refixing the electrical meter of the Petitioner herein bearing Meter No.7451269 and pass other order or orders...."

3. The limited relief as sought for by the petitioner is a direction to the respondent Nos.2 and 3 to consider the petitioner's representations dated 08.07.2024, 12.07.2024 and 16.07.2024 in accordance with law and to pass appropriate orders on the said representations of the petitioner.

It is the specific case of the petitioner that the said representations pertain to restoration of electricity connection to the petitioner's property vide meter No.7451269 and the petitioner further sought for laying of electrical lines in the entire subject layout situated at Plot No.269, admeasuring to an extent of 300 sq.yards in Survey Nos.186, 187 and 188 situated at Balaswamy Nagar, Vattinagulapally Village, Rajendra Nagar Mandal, Ranga Reddy District and petitioner's applications had been registered vide PR.No.91507024778 and Reg.No.CC915223043404 dated 28.06.2022.

Sri R.Vinod Reddy, learned Standing Counsel appearing on behalf of respondents on instructions submits that the petitioner made representations dated 08.07.2024, 12.07.2024 and 16.07.2024 to respondent Nos.2 and 3, whereas the competent authority to consider the said representations in fact is the Superintendent Engineer (Operation), Kukatpally Division, 3 Hyderabad and the said Authority was not impleaded as a party in the present writ proceedings by the petitioner herein.

Learned standing counsel appearing on behalf of the respondents submits that the if the petitioner puts forth petitioner's grievance as put forth in petitioner's representations dated 08.07.2024, 12.07.2024 and 16.07.2024 to the Superintendent Engineer (Operation), Kukatpally Division, Gachibowli, the same would be considered in accordance to law within a reasonable period.

Taking into consideration the submissions made by learned Standing Counsel appearing on behalf of respondents, the writ petition is disposed of directing the petitioner to put forth petitioner's grievance to the Superintendent Engineer (Operation), Kukatpally Division, Gachibowli, Hyderabad pertaining to restoration of electricity connection in respect of applications registered as PR.No.91507024778 and Reg.No.CC915223043404 dated 28.06.2022, as put-forth in petitioner's representations, dated 08.07.2024,12.07.2024 and 16.07.2024 within a period of one (1) week from the date of receipt of a copy of this order and the concerned 4 authority i.e. Superintendent Engineer (Operation), Kukatpally Division, Gachibowli, Hyderabad is directed to consider the same within a period of one(1) week thereafter in accordance to law and pass appropriate orders by providing an opportunity of personal hearing to the petitioner in conformity with principles of natural justice and duly communicate the decision to the petitioner.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
