SECOND APPEAL NO. 714 OF 2005
JUDGMENT:
Plaintiff has filed O.S. No.2099 of 1996 on the file of XIX Junior Civil Judge, Siddipet, for recovery of vacant possession. The trial Court dismissed the suit. The unsuccessful plaintiff preferred appeal vide A.S.No.396 of 2001 wherein the appellate Court allowed the appeal, against which the second appeal has been filed.
2. A perusal of the docket proceedings shows that the learned counsel for the appellants did not evince any interest to pursue the second appeal proceedings. On 14.08.2023, as there was no representation on behalf of the learned counsel for the appellants, the matter was directed to be listed under the caption 'for dismissal'. Even today also, there is no representation for the appellants. No purpose would be served in continuing the Second Appeal.
3. Accordingly, the Second Appeal is dismissed. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
