SECOND APPEAL No. 291 of 2009
JUDGMENT:
This Second Appeal is filed by the appellant - plaintiff aggrieved by the judgment and decree dated 19.01.2009 passed in A.S.No.447 of 2007 by the Chief Judge, City Civil Court, Hyderabad, confirming the judgment and decree dated 31.03.2007 passed in O.S.No.758 of 2006 by the II Junior Civil Judge, City Civil Court, Hyderabad.
2. When the matter came up for hearing on 28.08.2023, there was no representation by the learned counsel for the appellant. Accordingly, the matter was directed to be posted to 25.09.2023 under the caption 'for dismissal'. Even today also, there is no representation by the learned counsel for the appellant though the matter is posted under the caption 'for dismissal'. It appears that the appellant is not interested in prosecuting the matter.
3. As the appellant is not evincing any interest in proceeding with the matter, it is considered fit to dismiss the appeal.
4. Hence, the Second Appeal is dismissed for default. No order as to costs.
As a sequel, miscellaneous applications pending in this appeal if any, shall stand closed.
